Целевые ориентиры и принципы инновационной и экологической политики Республики Беларусь в контексте их взаимной интеграции: проблемы законодательного регулирования

Abstract

В современных условиях высокой актуальностью и практической значимостью обладает исследование взаимосвязей между инновационной и экологической политикой государства, выявление проблем их законодательного регулирования. Во введении указаны объект, предмет и цель исследования. Объект исследования – общественные отношения, связанные с реализацией государственной инновационной политики в области охраны окружающей среды и природопользования. Предмет исследования – нормы законодательства Республики Беларусь, регулирующие осуществление инновационной и экологической политики государства. Цель исследования – выработка рекомендаций по совершенствованию законодательной базы Республики Беларусь, регулирующей осуществление государственной инновационной политики в области охраны окружающей среды и природопользования. Научная новизна результатов исследования заключена в обосновании необходимости системной взаимосвязи между нормами законодательства, регулирующими осуществление инновационной и экологической политики государства. В основной части проведен анализ норм законодательства Республики Беларусь, устанавливающих целевые ориентиры и принципы реализации инновационной и экологической политики государства. Автором предложено уточнить установленную законодательством Беларуси формулировку цели государственной инновационной политики с учетом необходимости поддержки экологических инноваций. Выявлено соотношение между используемыми в законодательстве Республики Беларусь терминами «инновация» и «наилучшие доступные технические методы». Сформулированы и обоснованы авторские рекомендации по дополнению законодательно установленных в Беларуси перечней основных принципов государственной инновационной политики и регулирования отношений в области охраны окружающей среды. В заключении сформулирован вывод о необходимости системной увязки на законодательном уровне целевых ориентиров и основных принципов инновационной и экологической политики Республики Беларусь. Область применения полученных результатов исследования – правотворческая деятельность, научная деятельность, учебный процесс. In modern conditions, the research of the relationships between the innovation and ecological policies of the state and the identification of problems of their legislative regulation are of high relevance and practical significance. The introduction indicates the object, subject and purpose of the research. The object of the research is public relations related to the realization of the state innovation policy in the field of environmental protection and natural resource management. The subject of the research is legal norms of the Republic of Belarus regulating the realization of the innovation and ecological policies of the state. The purpose of the research is to develop recommendations for improving the legislative framework of the Republic of Belarus regulating the realization of the state innovation policy in the field of environmental protection and natural resource management. The scientific novelty of the research results consists in the substantiation of the need for a systemic relationship between the legislative norms regulating the realization of the innovation and ecological policies of the state. The main part contains an analysis of the norms of the legislation of the Republic of Belarus that establish targets and principles for the realization of the innovation and ecological policies of the state. The author proposes to specify the formulation of the goal of the state innovation policy established by the legislation of Belarus, taking into account the need to support ecological innovation. The relationship between the terms “innovation” and “best available technical methods” used in the legislation of the Republic of Belarus is revealed. The author’s recommendations for supplementing the lists of the basic principles of the state innovation policy and regulation of relations in the field of environmental protection, legislatively established in Belarus, are formulated and justified. In conclusion, the recap is formulated about the need for systematic coordination at the legislative level of targets and basic principles of the innovation and ecological policies of the Republic of Belarus. The sphere of application of the obtained research results is law-making activity, scientific activity, educational process.
